Terms and Conditions Effective 1/8/26
Thank you for choosing Living Eggs New Zealand. We are committed to providing an engaging,
educational and ethical hatching programme that allows children to experience the wonder of life while
promoting responsible animal care.
By confirming a booking with Living Eggs New Zealand, you agree to the following terms and conditions.
1. Bookings
Bookings are confirmed once a booking has been accepted in writing by Living Eggs New Zealand.
2. Payment
Invoices are payable by the due date stated on the invoice unless otherwise agreed in writing.
Late payments may incur administration fees and may affect future bookings.
3. Delivery and Collection
Living Eggs New Zealand will arrange delivery and collection dates with the participating organisation.
It is the responsibility of the organisation to ensure someone is available to receive and return the
equipment on the agreed date.
4. Care of Equipment
All incubators, brooder boxes, brooder heat plate, feeders, drinkers and other equipment remain the
property of Living Eggs New Zealand.
The organisation agrees to:
• take reasonable care of all equipment;
• use the equipment only for its intended purpose;
• supervise children when interacting with the equipment and chicks;
• keep equipment indoors in a clean, dry and secure location.
The organisation accepts responsibility for any loss or damage beyond normal wear and tear. Repair or replacement costs may be charged where equipment is lost, damaged through misuse or not
returned.
5. Electrical Safety
Living Eggs New Zealand is committed to providing safe equipment for use within participating
organisations. All electrical equipment supplied by Living Eggs New Zealand will be inspected, tested and tagged by a qualified person in accordance with applicable New Zealand electrical safety legislation and standards prior to each programme.
The participating organisation is responsible for ensuring that any electrical equipment they provide or
use in conjunction with the programme, including but not limited to multi-boards, extension leads and
power outlets, is safe, compliant with all applicable New Zealand legislation and standards, and suitable
for the intended use.
Where a multi-board or extension lead is required, the organisation must ensure it is in good condition, is not overloaded, and is used in accordance with the manufacturer's instructions and all relevant health
and safety requirements.
Living Eggs New Zealand accepts no responsibility for any loss, damage or injury arising from electrical
equipment that is not supplied by Living Eggs New Zealand, or from the misuse of electrical equipment
once the programme has been delivered.
6. Animal Welfare
The welfare of the chicks is our highest priority.
The organisation agrees to:
• follow all care instructions provided by Living Eggs New Zealand;
• ensure chicks have constant access to food, clean water and appropriate warmth;
• supervise all handling by children;
• never leave chicks unattended outside or exposed to extreme temperatures;
• immediately contact Living Eggs New Zealand if there are concerns about the health or welfare of
any chick.
Living Eggs New Zealand reserves the right to remove equipment or animals if animal welfare standards
are not being maintained.
7. Biosecurity
To protect the health of all birds, the organisation agrees to:
• practise good hand hygiene before and after handling chicks;
• prevent contact between programme chicks and other poultry or birds where possible;
• follow any biosecurity instructions provided during the programme.
8. Health and Safety
The organisation is responsible for maintaining a safe learning environment while the programme is on
site.
Living Eggs New Zealand recommends that:
• children wash their hands after handling chicks;
• chicks are kept away from food preparation areas;
• all participants follow normal hygiene practices.
The organisation remains responsible for supervising participants at all times.
9. Cancellation Policy
Cancellations made with reasonable notice may be rescheduled where possible.
Where eggs have already been set or programme preparation has commenced, cancellation fees may
apply.
Living Eggs New Zealand reserves the right to cancel or reschedule programmes due to unforeseen
circumstances, including biosecurity concerns, disease outbreaks or events beyond our reasonable
control.
10. Limitation of Liability
Living Eggs New Zealand takes every reasonable care in preparing and delivering the programme.
However, as the incubation of fertile eggs is a natural biological process, hatch rates cannot be
guaranteed.
Living Eggs New Zealand is not liable for losses arising from factors outside our reasonable control,
including natural hatch variation, transport delays, power failures at the venue, misuse of equipment or
failure to follow programme instructions.
11. Photography
Living Eggs New Zealand may request permission to use photographs of programme activities for
educational and promotional purposes. No identifiable images of children will be used without appropriate consent from the participating organisation and, where required, parents or caregivers.
12. Privacy
Any personal information collected during bookings will be used solely for the administration and delivery of the programme and will be handled in accordance with applicable New Zealand privacy legislation.
13. Acceptance
By confirming a booking, accepting delivery of the programme or paying an invoice, the individual on
behalf of the organisation acknowledges that it has read, understood and agrees to this External Provider Agreement.
